These Terms of Use govern your use of the Sweatistics app, website and related services, operated by Sweatistics LLC (“Sweatistics”, “we”, “us”). By using Sweatistics, you agree to these Terms and acknowledge our Privacy Policy.
Eligibility
You must be at least 13 years old to use Sweatistics. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you, and is responsible for your use of Sweatistics.
Fitness tracking only
Sweatistics is a fitness and nutrition tracking tool. It does not provide medical diagnosis, treatment, emergency services, or a substitute for professional medical advice. Features such as Coach and AI suggestions are for personal tracking support only. Consult a qualified healthcare professional when appropriate.
Estimates only
Calorie totals, macros, nutrition values, GPS distance, pace, elevation, step counts and similar figures shown in Sweatistics are estimates. They may depend on food databases (including USDA FoodData Central and Open Food Facts), your entries, device sensors, GPS conditions and optional AI suggestions. They are for personal fitness and nutrition tracking only, not medical nutrition therapy, clinical advice, or guaranteed accuracy.
Run tracking while your phone is locked depends on iOS location services and may pause, stop or be less accurate when the signal is weak, when permissions change or when iOS limits background activity. Continuous GPS use increases battery consumption. Sweatistics is not a safety or emergency device.
Your account
You are responsible for maintaining the security of your account credentials and for activity performed through your account. Information you provide should be accurate to the best of your knowledge.
Your data and content
You retain ownership of information and content you submit to Sweatistics (including text entries and photos you choose to provide). You grant Sweatistics a limited, worldwide, non-exclusive license to host, store, process, sync, transmit, and display that content solely as needed to operate and improve the features you use — including:
- syncing optional profile and personal background photos via private cloud storage linked to your account;
- processing optional activity-attachment photos on your device (not cloud-synced);
- transmitting a photo you select for optional Cardio Photo Log to our AI provider so suggested activity fields can be prepared for your review; and
- transmitting a photo you select for optional Scan Food (Premium) to our AI provider so suggested nutrition fields can be prepared for your review in Add Food.
You are responsible for having the rights to any photo or content you upload. Do not upload content that infringes others’ rights or that you are not authorized to share.
Apple Health and connected devices
If you choose to connect Apple Health, Sweatistics may display fitness information that Apple Health makes available after you grant permission, including step totals from compatible devices such as Apple Watch. The availability, accuracy and completeness of that information depend on Apple Health and the devices or services supplying the data. You control Apple Health permissions and may revoke them at any time. Sweatistics requests read-only access to step count and does not write health data to Apple Health.
Acceptable use
You may not use Sweatistics to interfere with the service, attempt unauthorized access, abuse automated systems (including AI features), violate applicable law or infringe the rights of others.
AI-assisted features
Optional AI features — Coach, voice logging, Cardio Photo Log image analysis and Premium Scan Food image analysis — send limited content you provide to our AI provider (currently OpenAI) when you use them, as described in our Privacy Policy. AI-generated output may be incomplete, inaccurate, or unsuitable for your circumstances.
You are responsible for reviewing suggested entries, calorie, macro, activity or other values before relying on them or saving them. Sweatistics requires your confirmation before certain AI-assisted entries are saved, including Scan Food suggestions. AI features are not medical advice and do not diagnose, treat, or replace a healthcare professional.
Subscriptions and Premium
Some features (such as Voice Log, Scan Food and Cardio Photo Log) require Sweatistics Premium (paid subscription) or, during limited beta programs, a temporary promotional Premium grant (see below).
Paid Premium (App Store)
When offered through Apple:
- Price (U.S. reference): Premium is offered at $9.99 per month or $59.99 per year, unless a different price is shown in the store at purchase time. The price charged is the price displayed by Apple before you confirm.
- Free trial: Eligible new subscribers may receive a 7-day free trial. Payment is charged to your Apple Account when the free trial ends unless you cancel at least 24 hours before it ends. Any unused part of a free trial is forfeited when you purchase a subscription.
- Auto-renewal: Subscriptions automatically renew for the same period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-applicable rate.
- Manage / cancel: Manage or cancel anytime in your App Store account settings (on iPhone, Settings → [your name] → Subscriptions, or the path Apple provides in your iOS version). Deleting the Sweatistics app or your Sweatistics account does not by itself cancel an Apple subscription.
- Without a free trial, payment is charged to your Apple Account at confirmation of purchase. Refunds are handled by Apple under its policies. Apple’s Media Services Terms also apply.
Beta Premium (temporary promotional access)
During TestFlight / beta programs, Sweatistics may grant temporary Premium access at no charge. Beta Premium:
- does not require payment;
- does not automatically convert into a paid subscription;
- remains available for the duration of the beta program (open-ended — no fixed end date), or until Sweatistics disables the grant in live config; and
- is separate from paid Premium purchased through Apple.
When beta access ends, paid features require a store subscription unless another promotional grant applies.
Apple App Store terms
If you downloaded Sweatistics from the Apple App Store, your license to use the app is governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms add to the Standard EULA. If there is a conflict between these Terms and the Standard EULA regarding your license to the app, the Standard EULA controls.
You and Sweatistics LLC acknowledge that these Terms are between you and Sweatistics LLC only, not Apple. Sweatistics LLC, not Apple, is solely responsible for the app and its content, maintenance and support, and for addressing any claims relating to the app (including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection, privacy or similar legislation, and intellectual property infringement claims). Apple has no obligation to provide any maintenance or support services for the app. To the maximum extent permitted by law, if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app; Apple has no other warranty obligation with respect to the app.
You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (such as your wireless data service agreement) when using the app.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and of the Standard EULA. Once you accept these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.

Availability and changes
Sweatistics may add, remove or modify features over time. We may temporarily limit access for maintenance, security, legal or technical reasons.
No warranty
Sweatistics is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee uninterrupted availability or that every feature or result will be error-free.
Limitation of liability
To the extent permitted by applicable law, Sweatistics will not be liable for indirect, incidental, special or consequential damages arising from use of the service.
Termination
You may stop using Sweatistics at any time, and you can delete your account in the app. We may suspend or terminate access when reasonably necessary to protect users, comply with law, enforce these Terms or protect the service.
Changes to these Terms
We may update these Terms as Sweatistics evolves. The current version will be posted on this page with an updated date. When we make material changes, we will ask you to review and accept the updated Terms in the app.

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Exclusive venue for disputes arising under these Terms shall be the state or federal courts located in Broward County, Florida, unless applicable law requires otherwise.
